Primero que todo quería preguntarle por la expectativa que puede haber por esta propuesta. Van a haber muchas familias beneficiadas en caso de que se pueda reducir este tiempo de separación?

    Desmond P. Fitzgerald (DPF): Si, esta propuesta (I-601A waiver) es una propuesta muy buena que va a tener un impacto dramático para mucha gente. Especialmente para personas que están aquí con familias con ciudadanía, como una persona que haya entrado sin permiso y este casado con un americano y quiere sus papeles pero no puede hacerlo con el sistema de ahora sin regresar a su país por mucho tiempo. Esta propuesta va a permitir que este tipo de persona reciba el perdón que ellos necesitan aquí en Estados Unidos. Y el proceso de perdón toma de 11 a 14 meses, y usualmente la persona está afuera de EE.UU por todo este tiempo. Y si esta propuesta es aceptada, la gente puede obtener este perdón aquí, en este país, y esto va a reducir el tiempo que la familia esta separada, con alguien por fuera de Estados Unidos.

    NTN: Hay una condición para acceder a este beneficio, dice que el familiar estadounidense debe demostrar que la ausencia de su pariente le representa un prejuicio extremo económico o humanitario. ¿Que deben hacer las familias estadounidenses que además tienen miembros que son inmigrantes indocumentados? ¿Cómo deben presentar este alegato ante las autoridades de Estados Unidos?

    DPF: Ese es un punto bien importante. Esta ley no es para todos. Es para personas que pueden demostrar que la separación con personas de su familia va a tener un impacto dramático (bien duro) para las personas con ciudadanía aquí. Por ejemplo, si un papa necesita salir por un año, o un año y medio, para esperar y obtener su visa fuera de EE.UU, y no hay nadie aquí para trabajar y soportar la familia. Este tipo de condiciones pueden demostrar al gobierno que este papá necesita vivir aquí, y no puede pasar mucho tiempo fuera. Otro ejemplo es si una persona de la familia esta fuera, muchas veces los niños también necesitan salir del país por que no hay nadie aquí que los cuide. Ellos necesitarían asistir a una escuela fuera de aquí, y muchas veces no hablan el idioma o no tienen una casa. Hay muchas maneras que las personas aquí pueden utilizar para demostrar que el impacto a la familia es bien duro si una de las personas de la familia esta fuera del país.
